| Terms and Conditions
Affiliate Contract
Sports Fan Warehouse Agrees to:
1.Send payment of 10% of gross sales that were generated through the affiliates direct link provided by Sports Fan Warehouse, not including shipping and handling charges or sales tax, minus discounts/coupons customers have used and minus returns.
2. Payments will be made on a quarterly basis and will be sent within 45 days of the quarter's end. We will send you a check for the referral fees earned subject to our standard terms and conditions. In calculating referral fees, we will deduct the corresponding referral fee from your next payment if a product that generated a referral fee is returned by the customer. If there is no subsequent payment, we will send you a bill for the referral fee.
3. Provide Affiliate online access to sales commission data.
Affiliate agrees to:
1. Place buttons, banners and/or links on appropriate pages of its website, linking to the aforementioned site offering items for sale to web visitors.
2. Affiliate represents and warrants that neither its web site ("Affiliate Web Site") nor any content or technology thereon:
(a) infringes on any third party's intellectual property, publicity, or privacy rights
(b) violates any law or regulation
(c) is threatening, defamatory, obscene, harmful to minors, or contains nudity or pornography
(d) contains any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information
(e) is materially false, inaccurate, or misleading
(f) promotes violence
(g) promotes discrimination based upon race, sex, religion, nationality, disability, sexual orientation or age
(h) promotes the use of bulk email or spam
(i) promotes the use of pyramid schemes
(j) promotes illegal gambling or sports betting
Both parties agree to the following:
1. Either party may cancel this agreement at any time, by providing a 30-day notice. This agreement will be canceled immediately by Sports Fan Warehouse if any of the items in section 2 above are violated.
2. Parties understand that no sales guarantees are expressed or implied.
